It appears that Partition Suit No.76 of 1974 was disposed of in terms of compromise against the defendants except defendant no.11 who had contested the suit. The defendant no.11 has filed this appeal against the plaintiffs and other defendants. It appears that the appellants have ceased to have any interest in prosecuting this appeal.

In the facts and circumstances, this first appeal is dismissed.
