The petitioner seeks bail in anticipation of his arrest in connection with Silao P.S. Case No. 217 of 2018 dated 03.10.2018 instituted for the offences under Sections 30 & 30(g) of the Bihar Prohibition and Excise Act, 2016.

Regard being had to the recovery of 379 litres from a vehicle of which the petitioner is the driver, I am not inclined to grant anticipatory bail to him. Accordingly, the prayer for anticipatory bail is rejected.

In case the petitioner surrenders and prays for bail, the court below shall take into account that the recovery was from the boot of the vehicle and that the
