Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code.
As per prosecution case, two unknown miscreants, riding on motorcycle, committed murder of maternal uncle of the informant. Petitioner is son of the deceased. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is next submitted that petitioner is not named in the F.I.R. and his named transpired during course of investigation. He further submits that petitioner and his mother had no concern
Patna High Court CR. MISC. No.8203 of 2023(2) dt.12-05-2023 2/2 with the deceased and there is no direct or indirect evidence to show his involvement in the alleged incident. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P. S. Case No. 84 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
