12.02.2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner is permitted to make correction in the prayer portion of the application with regard to the Sessions Trial number and the name of the Court. Let the same be done during the course of the day. The petitioner seeks provisional bail in Laukahi P.S. Case No. 92 of 2013 dated 31.08.2013 instituted under Sections 363/364/34 of the Indian Penal Code. The petitioner had earlier moved for bail in Cr. Misc. No. 7957 of 2014, which was rejected by order dated 22.07.2014.

Learned counsel for the petitioner submits that the marriage of his daughter has been fixed for 16.02.2015 and thus the petitioner may be granted

Patna High Court Cr.Misc. No.6132 of 2015 (2) dt.12-02-2015 2/2 provisional bail for 15 days to take part in the ceremony and also perform necessary rituals.

Learned A.P.P. does not oppose the prayer for provisional bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on provisional bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, IV, Madhubani in Laukahi P.S. Case No. 92 of 2013 corresponding to G.R. No. 1182 of 2013 and Sessions Trial No. 347 of 2014.

The petitioner shall surrender before the Court below latest by 10th March, 2015. An affidavit shall be filed in the present case enclosing copy of the surrender certificate latest by 13th March, 2015.

The application stands disposed off in the aforementioned terms.
