JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This application, for grant of anticipatory bail, arises out of Sasaram (T) Darigaon P.S. Case No. 1163/18, disclosing offences under Sections 379 and 461of the Indian Penal Code.
Allegation as per F.I.R. is that co-accused Giridhari Pal, who is peon of St. Michael School Sasaram, is of committing theft of Rs. Five lakhs, which was kept in Almirah and petitioners are said to be his son and wife. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and the F.I.R itself shows that there is no allegation against these petitioners of committing theft in the school.

Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (T) Darigaon P.S. Case No. 1163/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
