The petitioner is languishing in custody since 02.11.2014 in a case registered for the offences punishable under Sections 414, 401 of the Indian Penal Code and 20/22 of NDPS Act whereas the charge-sheet has been submitted under Sections 414, 401, 328, 379 of the Indian Penal Code and 28A of Drugs and Cosmetics Act.
From the possession of the petitioner two mobile phones, cash of Rs.1260/-, 20 Lorazepain tablets and 10 sachets white powder were recovered while the petitioner was roaming outside the railway station.
Patna High Court Cr.Misc. No.15609 of 2015 (02) dt.20-05-2015 2/2 It is submitted by learned counsel for the petitioner that there is no accusation that the petitioner administered the tablets to anyone and is in custody since 02.11.2014.
Considering the fact that the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhagalpur in connection with Rail Bhagalpur P.S. Case No. 63 of 2014.
Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
