Petitioner seeks bail in connection with Nagar P.S. Case No.663/2022, registered for the offence punishable u/s 323, 376, 504, 506/34 of the IPC.

Allegation against the petitioner is that he along with other co-accused persons took the informant to a house and confined her. Thereafter, petitioner abused, assaulted and forcibly made physical relationship with her continuously. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. It is submitted that there is love affair going on in

Patna High Court CR. MISC. No.4153 of 2024(7) dt.30-08-2024 2/2 between the petitioner and the victim and on her sweet will, she eloped with the petitioner. Petitioner has no criminal antecedent and he is languishing in custody since 30.09.2023. 5.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail by submitting that there is ample evidence against the petitioner and the medical report has supported the prosecution case.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of bail on his behalf is hereby rejected.

This application is accordingly dismissed.
