JUSTICE MADHURESH PRASAD ORAL ORDER 27-02-2020 The petitioner has assailed the selection of respondent No. 7 before the Sub Divisional Officer, Rohtas. The same has been rejected. The consideration has been done by the SDO in view of the representation filed by the petitioner pursuant to order dated 3.4.2019 passed in CWJC No. 5230 of 2019. The petitioner has assailed the selection of respondent No. 7 as Vikash Mitra on the ground that though she was not resident of Sahpur, she has obtained the selection by misrepresenting her permanent residence. Reliance is placed by the petitioner on the residence certificate which is Annexure 2 and issued in March

Patna High Court CWJC No.2948 of 2020(2) dt.27-02-2020 2/2 2010 showing the private respondent to be a resident of Tilokhar Panchayat.

Learned State Counsel referring to the order of the SDO, Dehri, submits that pursuant to petitioner's representation the issue was enquired by the SDO, Dehri, Rohtas. One residence certificate issued on 13.5.2010 vide Memo No. 2312 has been considered by the SDO to hold that in view of a valid residence certificate certifying her to be resident of Sahpur no interference is required in the selection of respondent No. 7 on the basis of allegation levelled by the petitioner based on earlier residence certificate which showed her to be resident of another place. Residence certificate dated 13.05.2010, till date has not been cancelled.

This Court therefore does not find any reason to interfere with the said order.

The writ petition is dismissed.
