The petitioner apprehends his arrest in Obra P.S. case No.76 of 2016 under Section 147, 148, 149, 323, 325, 307, 435, 295A of the Indian Penal Code.

The petitioner and other accused persons are alleged to have assaulted the informant and others and set ablaze the graveyard.

The learned counsel for the petitioner submits that omnibus and general allegation is made against all the accused persons. Similarly situated 10 other accused persons have already been granted anticipatory bail vide order dated 23.09.2016 passed in Cr. Misc. No. 39765 of 2016 and the case of petitioner stands on the same footing.

Patna High Court Cr.Misc. No.45777 of 2016 (2) dt.25-11-2016 2/2 Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Daudnagar, Aurangabad in Obra P.S. Case No. 76 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
