JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Tarapur P.S. Case No. 168 of 2019 for the offenses under Sections 419, 420 and 34 of the Indian Penal Code and Section 66 of IT Act.

Allegation against the petitioner is that he was advised by Ashutosh Kumar for opening several bank accounts and only on his advice he has opened the account and procured ATM cards for transaction of money.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 08.11.2019.

Considering the fact that the petitioner has no criminal

No.348 of 2020(2) dt.28-01-2020 2/2 antecedent and he is not an account holder and he was not involved in illegal transaction in the bank accounts, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Munger in connection with Tarapur P.S. Case No. 168 of 2019.

Bailors shall be the family members.
