JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 31.10.2018 in connection with Banka P.S. Case No. 309 of 2018 registered for the offences punishable under Sections 376/34 of the Indian Penal Code and Section 4 of POCSO Act. The first information report goes to show that the allegation of rape is against co-accused Ashish Kumar and only allegation against the petitioner is that he got solemnized marriage of said Ashish Kumar with informant, who was minor at the time of alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount
