JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 Learned counsel for the petitioner seeks and is permitted to make necessary correction at paragraph-15 of the petition in course of the day.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against petitioner is that he, in the capacity of Branch Manager sanctioned loan to several persons but later on, in course of inquiry, it was found that the petitioner sanctioned the loan on the basis of forged land possession certificate.

Contention on behalf of the petitioner is that petitioner is languishing in judicial custody since long and moreover, several loanees have been depositing the loan amount regularly with the concerned bank.

No.14492 of 2015 (7) dt.14-09-2015 It would appear from the record that notice has been sent to the concerned bank to controvert the above-said submission of the petitioner but in spite of service of notice, none appears on behalf of the concerned bank to controvert the abovesaid submission. Considering the above-said submission as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sanokhar (Andanda) P.S. Case No. 81 of 2014 to the satisfaction of Sri A.R. Upadhyaya, J.M., Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
