Petitioner is seeking anticipatory bail in connection with Phulwari Sharif P.S. Case No.591 of 2018 registered for the offences punishable under Sections 401, 456 and 379 of the Indian Penal Code.

Learned counsel representing the petitioner submits that the name of this petitioner has transpired in the statement of the co-accused, Hemant Kumar. Learned counsel for the petitioner further submits that nothing has been recovered from the possession of the petitioner and that though he is an accused in two other cases, is presently on bail in those cases. In the given facts and circumstances of the case, considering and taking note of the fact that the name of the petitioner has transpired in the confessional statement of the coaccused and nothing has been recovered from his possession, in case of his arrest or surrender within four weeks from today let the petitioner abovenamed be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-cum-A.C.J.M. XV, Patna in connection with Phulwari Sharif P.S. Case No.591 of 2018 subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond.
