JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under sections 466, 467, 468, 471, 419, 420, 120B of the Indian Penal Code and sections 66 and 72 of the Information Technology Act, 2000. As per the F.I.R. the allegation is that in the examination of Staff Selection Commission a gang of 7-8 persons are trying to help the examinees after obtaining question paper through electronic device.
It has been submitted on behalf of the petitioners that they are in custody since 1.7.2016. Charge sheet has been submitted against the petitioners. The petitioners have no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. No specific allegation has been made
Patna High Court Cr.Misc. No.34760 of 2016 (3) dt.19-10-2016 against the petitioners. General and omnibus allegation has been made against them. They have been implicated in this case because they were working in a coaching institute, which was engaged in wrong practices of examination. Vide Annexure 4 series the other co-accused have been granted bail by this Court. Learned Senior counsel, appearing on behalf of the Economic Offences, submits that the petitioners are named in the First Information Report and had actively participated in the alleged offence.
Considering the aforesaid facts and circumstances, let the abovenamed petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Patna in Economic Offence P.S.Case No. 25/2012.
