The petitioner is languishing in custody since 16.12.2014 in a case registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code. From the house of the petitioner a Hero Honda motorcycle was recovered.
It is submitted by learned counsel for the petitioner that the recovery was not made from the house of the petitioner rather it was made from outside the house.
