KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The Petitioner who is in custody seeks bail in connection with Sessions Trial No. 345 of 2017 arising out of Phulwarisharif P.S. Case No. 27 of 2017 registered for the offence punishable under Sections 414, 302, 120B/34 of the Indian Penal Code.
The allegation against the petitioner is of murder. It has been stated by learned counsel for the petitioner that the petitioner has been falsely implicated in this case on mere suspicion. Learned counsel for the petitioner further submits that the petitioner has surrendered before the court below due to apprehension by the police otherwise nothing has come against the petitioner during investigation. It has been further submitted that similarly situated co-accused persons namely, Zahid Khan
Patna High Court Cr.Misc. No.36759 of 2017(2) dt.10-08-2017 2/2 and Md. Abid have been granted bail by a co-ordinate bench of this Court vide orders dated 06.07.2017 and 04.08.2017 in Criminal Miscellaneous No. 28394 of 2017 and Criminal Miscellaneous No. 29214 of 2017. The petitioner has got no criminal antecedent and is in custody since, 10.02.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Patna, in connection with Sessions Trial No. 345 of 2017 arising out of Phulwarisharif P.S. Case No. 27 of 17.
