JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 8 and other ancillary sections of the NDPS Act.

As per the prosecution case, 658 grams Ganja and 156 grams intoxicating substance have been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. There is no FSL report regarding nature of intoxicating substance and the house in question is his joint property. Quantity of recovery of ganja is less than the small quantity. He is in custody since 11.5.2021.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I cum Special Judge, Siwan in Guthani Police Station Case No. 33 of 2021.
