JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Janta Bazar P.S. Case No. 162 of 2017 registered under Sections 272/273/308 of the Indian Penal Code read with Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 09.09.2021, charge-sheet has been submitted and has antecedent of six cases and allegation is of recovery of 2600 litres of spirit from a truck, as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner was was not arrested at the spot and his name

Patna High Court CR. MISC. No.3406 of 2022(2) dt.04-03-2022 2/2 transpired in the confessional statement of co-accused. Learned counsel submits that the police deliberately implicated the petitioner in the present case, based on his antecedent at the instance of co-accused.

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and was not arrested at the spot, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Saran at Chapra in connection with Janta Bazar P.S. Case No. 162 of 2017.
