The petitioner seeks bail in Baisi P.S. Case No. 223 of 2014, registered for the offences punishable under Section 304B and other Sections of the Indian Penal Code.
The informant brother of the deceased made allegation that the petitioner-husband was always torturing her. The petitioner threw his daughter from the roof consequently she died. The deceased was ill and she was living in her Naihar, but the petitioner went there and injected her and consequently she died. Learned counsel for the petitioner submits that the viscera was kept reserved. There is no material to show that the petitioner injected poisonous injection.
On perusal of the records, it appears that the petitioner
Patna High Court Cr.Misc. No.8170 of 2015 (3) dt.07-04-2015 2/2 had earlier killed his daughter and he was always torturing his wife. The wife of course was ill, but the petitioner gave her injection and ultimately she died.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
