1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Bhimpur P.S. Case no. 41 of 2023 registered under sections 356 and 379 of the Indian Penal Code.
3. As per the prosecution case, the informant states that while he was returning home, three unknown persons on motorcycle looted the informant of his bag containing the company's laptop, purse, ATM cards etc.
4. Learned counsel for the petitioner submits that the F.I.R was registered against three unknown. The petitioner was falsely implicated in the alleged confessional statement of coaccused Sravan Kumar. It is submitted that contrary to the
Patna High Court CR. MISC. No.10132 of 2024(2) dt.22-02-2024 2/2 allegations, no incriminating article has been recovered from petitioner's possession who is in custody since 6.6.2023. He has not been put on T.I parade and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the material that has transpired in course of investigation according to which allegedly some of the stolen articles was recovered from the petitioner's possession, however the petitioner was not put on T.I. parade inspite of his being in custody for eight months since 6.6.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bhimpur P.S. Case no. 41 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- 1st Class, Birpur, Supaul.
