2. Petitioner seeks regular bail in connection with Jankinagar P. S. Case No. 193/2023 in a case registered for the offences punishable under Sections 25(1-AA), 25(1-A), 26(1) (2)/ 35 of Arms Act.
3. As per the prosecution case, on secret information, a raid was conducted in the house of co-accused Mithilesh Yadav and on search, several arms and ammunition were recovered. It is further alleged that one co-accused Jittu Kumar Yadav was apprehended on the spot who disclosed the name of this petitioner.
4. Learned counsel for the petitioner submits that no arms and ammunition were recovered from possession of the
Patna High Court CR. MISC. No.3102 of 2025(2) dt.06-03-2025 2/2 petitioner and he has been made accused only on the basis of confessional statement of co-accused. Petitioner claims clean antecedent and he is in custody since 09.07.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Jankinagar P.
