The petitioner is languishing in custody for the offences punishable under Sections 354/354B/506/34 of the Indian Penal Code and Section 8/11 of the POCSO Act. Learned counsel for the petitioner submits that initially the same informant Deo Narayan Raut has lodged Bettiah Town P.S. Case No.592 of 2019 against the petitioner for offences under Section 457 and 380 of the Indian Penal Code vide Annexure-2, since the petitioner is next door neighbour of the informant. The police did not find substance in the FIR and final form was submitted not sending up the petitioner

Patna High Court CR. MISC. No.12049 of 2021(2) dt.29-07-2021 2/2 for trial. Thereafter, just to harass false case of sexual harassment of the minor daughter of the informant is alleged against the petitioner. The petitioner is in custody since 14.10.2020. Investigation of the case is already complete. Considering the background and nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Bettiah Town P.S. Case No. 749 of 2019 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
