1. Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner is named in the F.I.R. and apprehending her arrest in connection with Sarairanjan (Ghataho) P.S. Case No. 37 of 2021 registered for the offences punishable under Sections 307 and 302/34 of the Indian Penal Code.

3. The allegation against the petitioner is to commit murder of the son of informant alongwith other co-accused persons/family members.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.8958 of 2024(2) dt.20-02-2024 2/3 petitioner submitted that allegation to commit murder is specific against husband of petitioner as per FIR, where implication of this petitioner only appears being wife, where informant is related with petitioner as sister-in-law. It is submitted that husband of petitioner out of mental breakdown even assaulted his eight year old son with knife. While concluding the argument it is submitted that petitioner herself is victim of circumstance, who is a lady of clean antecedent.

5. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of the facts and circumstances and by taking note of the fact as allegation to commit murder is specifically available against husband of petitioner, where informant is an eye-witness of the occurrence and moreover, petitioner is a lady of clean antecedent, accordingly the petitioner above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur/concerned Court below where the case is pending in connection with Sarairanjan (Ghataho)
