The petitioner seeks bail in Chainpur P.S. Case No. 180 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, one unknown person riding on motorcycle snatched double barrel gun of informant and fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. No incriminating article has been recovered from his possession. The alleged double barrel gun recovered from the house which is in joint possession of family. Petitioner is in custody since 04.09.2021. Counsel for State however, vehemently opposed the

Patna High Court CR. MISC. No.2085 of 2022(3) dt.28-04-2022 2/2 prayer for bail and submitted that alleged double barrel gun has been recovered from the house of this petitioner and informant and his daughter also identified this petitioner. Considering the fact that the alleged gun has been recovered from house of this petitioner and he was identified by the informant and his daughter, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
