02. Heard learned counsel for the petitioners and learned A.P.P. for the State.

03. In the present case, the petitioners seek bail in connection with Sasaram (Town) P.S. Case No. 852 of 2025, registered for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2), 109(1), 352 of the BNS and Section 27 of the Arms Act.

04. As per the prosecution case, police received information about two groups indulging in firing. The informant with her police party reached the spot and found two cars parked there. Some spent cartridges and pellets were found near the car as well as in one of the vehicles. The police on inquiry came to know about the petitioners who were involved along with other co-accused persons in the aforesaid occurrence.

05. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the said case. There is no specific allegation against the petitioners for any overt act. There is no eye witness or independent witness to support the prosecution case against the petitioners. No Test Identification Parade has been conducted. Nothing incriminating has been recovered from person or possession of these petitioners. There is no material to show the involvement of the petitioners in the whole occurrence. Petitioner Ankush Kumar is having antecedent of one case in which he is on bail and petitioner Ravi

3/4 Kumar is having clean antecedent. Petitioners are in custody since 02.11.2025.

06. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague nature of allegation against the petitioners and period of custody of the petitioners, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned CJM, Sasaram/concerned court, in connection with Sasaram (Town) P.S. Case No. 852 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three

4/4 consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
