The petitioner seeks bail in connection with Special Case No.47 of 2016, arising out of Vigilance P.S. Case No.105 of 2016, registered under Sections 420, 467, 468, 471, 472, 477(A), 409 and 120(B) of the Indian Penal Code read with Sections 13(2) and 13(i)(D) of the Prevention of Corruption Act, 1988.

The accusation is that the petitioner being the Principal of Bisheshwar Dayal Sinha Menorial Mahila College, Chapra, which is governed under the J.P. University, Chapra, after receiving the grant-inaid, disbursed the same to the persons, more than the sanctioned strength of the teaching and non teaching staff of the college, in

Patna High Court Cr.Misc. No.45566 of 2017 (4) dt.14-12-2017 2/2 collusion with the members of the Governing body and Secretary of the College.

Learned counsel appearing on behalf of the petitioner submits that the petitioner, who is lady, joined as a Principal in the said college on 02.07.2008 and during her tenure, only one time grant-in-aid was allocated to disburse the same to the teaching and non teaching staff of the said college, appointed more than the sanctioned strength. There is no allegation against the petitioner of misappropriating the grant-in-aid. The petitioner is in custody since 17.08.2017. Further submission is that, on investigation, the chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Special Case No.47 of 2016, arising out of Vigilance P.S.
