BAJANTHRI) 25-02-2025 Pursuant to earlier order dated 11.02.2025, Law Secretary is present in the Court.
2. Learned Advocate General after perusal of the records submitted that there is no opinion for filing LPA. On the other hand, department officials have proceeded to file LPA.
3. Be that as it may, reading of the learned Single Judge order dated 16.07.2019 read with our previous order dated 11.02.2025. It is a clear case for imposition of cost as well as taking necessary action against officer by name Chandra Shekhar Prasad Sharma who was the then Deputy Director (Secondary Education) Bihar, Patna for violating procedural aspects insofar as filing LPA and so also for filing frivolous LPA. In this regard, the Competent Authority is hereby directed to initiate inquiry under relevant rules and conclude the same within a period of six months from the date of receipt of this order and inform the decision of the disciplinary proceedings to this Court.
4. Accordingly, the present LPA No. 112 of 2021 stands dismissed with cost of Rs. 10,000/- (Rupees Ten
Patna High Court L.P.A No.112 of 2021(4) dt.25-02-2025 3/3 Thousand Only). Cost shall be remitted in the Lawyers' Association Welfare Benevolent Fund, Patna bearing Account No. 7801893276, IFSC Code- IDIB000l501.
