The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 326, 307, 504, 506 of the Indian Penal Code.
Allegation against the petitioner is that he assaulted the informant with iron rod.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is admitted land dispute between the parties which has been admitted in the fardbeyan. Patna High Court CR. MISC. No. 2662 of 2023(2) dt.09-02-2023 2/2 submits that there is specific allegation against the co-convict, Keshav Chaudhary, who assaulted the informant with knife due to which the eye of the informant damaged. He also submits that petitioner has no criminal antecedent as mentioned in para3 of this application. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Moro P.S.
