The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other co-accused persons embezzled cash of Rs. 11,78,035/- which was sanctioned as loan amount to the 23 poor women. It is submitted that petitioner has been falsely implicated in this case only suspicion. No money was transferred in the account of petitioner. At the relevant time petitioner was Field Development Officer and having no right to approve and sanction the loan amount, as such he cannot be held responsible for the alleged occurrence. Moreover, he is ready to deposit three lakhs in the court below through cheque at the

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Barh, Patna in connection with Barh P.S. Case No. 501 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner will deposit Rs. three lakhs through cheque before the court below at the time of furnishing bail bond which shall be subject to final outcome of this case.
