The present writ petition has been filed for the following reliefs:- (i) a certiorari setting aside the notice dated 17.12.2019 contained in letter No.29 issued under the signature of Panchayat Secretary, Gram Panchayat-Kasdeura, BlockMharajganj, District-Siwan and its consequential decision, if
Patna High Court CWJC No.1273 of 2020(2) dt.31-07-2023 2/3 any, whereby and where-under the Respondent concerned has in a very illegal, arbitrary, suspicious and casual manner, directed the petitioner to remain present for discussion of "No Confidence Motion' scheduled to be held on 21.12.2019 at 11.00 A. M. in Lohiya Bhawan, Kasdeura Bangra, alleging very vague and absurd allegation of wrong behaviour and wrong functioning of the petitioner which was served upon the petitioner only on 19.12.2019 i.e. without following the prescribed rules of Gram Panchayat Raj Act, 2006; (ii) a Mandamus commanding and directing the Respondent concerned not to give effect the consequential action, if any, in pursuant to impugned notice dated 17.12.2019 contained in letter No.
29 was held against the petitioner; (iii) a further writ of Mandamus commanding and directing the Respondent authority concerned not to disturb the functioning of petitioner as elected Deputy Mukhiya of Gram Panchayat- Kasdeura, Block-Maharajganj, District-Siwan until the fresh 'No Confidence Motion' was held against the petitioner as per prescribed rules of Gram Panchayat Act, 2006 in this regard.
Learned counsel for the State submits that the matter has become infructuous.
