The petitioner apprehends his arrest in Complaint Case No.1371 of 2016 registered under Sections 323, 406 and 498A of the Indian Penal Code but cognizance was taken under Section 498A of the I.P.C.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is ready to pay a sum of Rs.1,000/- per month as maintenance to his wife (opposite party no.2). The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.3149 of 2020(11) dt.07-04-2022 2/2 of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Nawada in connection with Complaint Case No.1371 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
