JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-03-2021 The grievance of the petitioners in the present writ application is arbitrariness in the matter of selection of Home Guard in the District of Supaul. Advertisement No. 02 of 2011 was issued by the respondents for empanelment of the candidates for appointment as Home Guard.

Mr. Kumar Kaushik, learned counsel for the petitioners would submits that contrary to the spirit of the advertisement, the respondents have arbitrarily considered the case of the petitioners on the basis of block which has resulted into discrimination. Similar issue was considered by this Court in

5/5 relation to selection of Home Guard in the District of Muzaffarpur. This Court has considered the aforesaid aspect and directed the respondents to adopt corrective measures in the light of the advertisement dated 16.07.2011.

In order to maintain consistency, the present writ application is also allowed and disposed off with a direction to the respondents to consider the case of the petitioners on the basis of District-wise merit list and not confine the candidature of the petitioners to a particular Block. The corrective measures must be taken by the respondents at the earliest, preferably within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observation/direction, the writ application stands disposed off.
