The petitioner seeks bail in a case registered for offences under Sections 420 and 120B of the Indian Penal Code and Sections 30 (A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 461.64 litres of foreign liquor were recovered from the Maruti Zen which was being boarded by three persons including the petitioner. Petitioner claims that he is having clean antecedent and is in
Patna High Court Cr.Misc. No.36516 of 2017(2) dt.10-08-2017 2/2 custody since 24.05.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Economic Offence P.S. Case No. 9 of 2017 (Special No. 2032 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
