JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. In this case, the petitioner is seeking anticipatory bail in connection with Rahui P.S. Case No. 330 of 2018, registered for the offence punishable under Sections 147, 149, 323, 504, 506 and 307 of the Indian Penal Code and under Section 27 of the Arms Act.

Allegation has been made that the petitioner has resorted to firing, which caused injury to Ajay Yadav. The petitioner has criminal antecedent.

Learned counsel for the petitioner submits that in one case there is a final form, with respect to two other cases

Patna High Court Cr.Misc. No.3435 of 2019(2) dt.25-01-2019 2/2 the petitioner has been acquitted.

Looking to the nature of allegation and also the fact that the petitioner has criminal antecedent, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
