JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This application, for grant of anticipatory bail, arises out of Powakhali P.S. Case No. 53 of 2018, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code. Allegation against the petitioner is that on enquiry it was found that she ha appeared in the examination of matriculation twice through two different educational institutions and has mentioned two different date of birth. Submission of learned counsel for the petitioner is that she has falsely been implicated in this case at the instance of one Soma Kumari as petitioner was appointed as a teacher on her place and the real date of birth of the petitioner is 05.12.1972 and so allegation that she has earlier also appeared in the matriculation examination by showing the date of birth as 03.12.1964, is false and concocted and except name and date of

Learned counsel for the State opposed the prayer for bail.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Kishanganj, in connection with Powakhali P.S. Case No. 53 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
