Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.5.2014 in a case registered for the offences punishable under Sections 328 and 379 of the Indian Penal Code.
The accusation is of offering coffee mixed with ativan tablet during train journey and committing theft of articles and cash of rupees twenty five thousand of the informant. It is submitted by the learned counsel for the petitioner that subsequently the petitioner was remanded in the present case. There is no recovery from the petitioner and the petitioner refused
Patna High Court Cr.Misc. No.6534 of 2015 (2) dt.19-02-2015 2/2 to participate in the Test identification parade on two dates. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Asstt. Sessions judge cum CJM, Begusarai in connection with Barauni Rail P.S. Case No. 3 of 2014. Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions.
