1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhaptiyahi P.S. Case no. 215 of 2024 registered under sections 140(3), 103(1), 238, 61

(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that her son who started from the house did not return and was not to be found inspite of search. It is further stated that for the last one year her daughter in law was on talking terms with the petitioner. She is convinced that the petitioner has a hand in the disappearance of her son.

4. It is submitted by learned Senior Counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegation of the petitioner having an affair with the wife of the deceased is false and concocted. Even accepting the

No.1587 of 2025(5) dt.15-04-2025 2/2 same for the sake of argument, there is no material that has transpired in course of investigation to connect the petitioner with the alleged crime. With respect to the so called confessional statement given by the petitioner, it is submitted that the same is inadmissible and the dead body of the deceased had been recovered more than 12 hours before the alleged confessional statement. The petitioner is in custody since 4.9.2024 and undertakes to cooperate in the trial.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the material that has transpired in course of investigation, his being in custody since 4.9.2024 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bhaptiyahi P.S. Case no. 215 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul.
