Heard learned counsel for the petitioner, learned A.P.P and learned counsel for the informant.

The petitioner apprehends his arrest in Chandi P.S. Case No. 30/2016, registered for the offences punishable under Sections 406, 420, 504 and 34 of the Indian Penal Code. The informant alleged that the petitioner and others took money from him on the pretext of providing job. The informant paid Rs. 3,50,000/- to the petitioner his father and others.

Learned counsel for the petitioner submits that the informant deposited Rs. 25,000/- in his account. He never gave any assurance to provide any job to the informant. The father of

Patna High Court Cr.Misc. No.1259 of 2017 (2) dt.16-01-2017 2/2 the petitioner has already been enlarged on provisional bail. Petitioner is ready to return Rs. 25,000/- to the informant within three weeks.

Considering the facts aforesaid and the fact that petitioner is ready to return Rs. 25,000/- to the informant which was deposited in his account by the informant within three weeks, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IVth, Bhojpur at Ara in connection with Chandi P.S. Case No. 30/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
