The petitioner is languishing in custody since 04.05.2014 in a case registered for the offences punishable under Sections 341, 323, 307, 354, 504, 506 and 379 of the Indian Penal Code. It is alleged that co-accused Soli Rai assaulted the mother of the informant on the head with butt of pistol then the petitioner alongwith others tried to outrage the modesty of the informant as well as her mother when Ankit Kumar protested then all the accused persons assaulted him with Farsa and Lathi and they also snatched gold earrings of the mother of the informant. It is submitted by learned counsel for the petitioner that specific accusation is against Soli
Patna High Court Cr.Misc. No.8230 of 2015 (2) dt.04-03-2015 2 / 2 Rai whereas co-accused Soli Rai has been granted bail by a co-ordinate Bench of this Court after going through the case diary which reflects no injury was caused to the mother of the informant. Accusation of assaulting Ankit Kumar is omnibus and general against the accused persons. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent and Demarcation Appeal No. 08 of 2012-13 is pending between the parties.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, Patna, in connection with Bakhtiarpur P.S. Case No. 35 of 2014.
