JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Matiyariya P.S. Case No. 95 of 2021 registered under Sections 30(a), 30(c) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 06.11.2021, charge-sheet has been submitted and is a persons with clean antecedent and allegation is of recovery of articles used for preparing liquor, as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner is a shop owner and since he was not agreed the desire

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.500/- (Rupees five hundred) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Bettiah, West Champaran in connection with Matiyariya P.S. Case No. 95 of 2021.
