JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in jail since 23.07.2014 in a case registered under Sections 323, 341, 342, 376 of the I.P.C. and 28 of Juvenile Justice Act.

In course of investigation, the statement of the victim was recorded at paragraph no. 3 of the case diary in which she stated that the petitioner took her and attempted to commit rape and assaulted her. The medical report of the victim reflects that one injury was found below her left eye and except the aforesaid injury, no any other injury was found on the person of the victim. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, in connection with Jandaha P.S.
