This is a petition for grant of regular bail for offence under Sections 302, 394, 307, 341, 323, 325 and 120B of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is no allegation of assaulting upon the deceased. It has, further, been submitted that the allegation is that the petitioner has given a lathi blow which hit the informant of the case. Further, it has been submitted that no specific injury or overt act has been alleged against the petitioner as far as the deceased is concerned. Further, it is submitted that the petitioner has got no criminal antecedents and he is in jail since 04.03.2015. On behalf of the State, it has been submitted that there is specific allegation against the petitioner and the petitioner is in custody since 04.03.2015, i.e., for only last three months.

Patna High Court Cr.Misc. No.15858 of 2015 (2) dt.09-06-2015 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.

The prayer for bail is rejected.

Any how, the petitioner may renew his prayer for bail after six months in custody.
