The petitioner is languishing in custody since 23.01.2015 in a case registered for the offences punishable under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code. The prosecution case is that the informant being the Branch Manager of PNB Nabinagar Branch alleged that the Bank Clerk, namely, Anil Kumar brought a body namely, Vinay Kumar, who came to receive cheque book against the account of Arjun Ram. Vinay Kumar confessed that he was entrusted with the signature of Arjun Ram by this petitioner and also admitted that earlier also he withdrew Rs.1,74,000/- in the similar manner by getting cheque book issued fraudulently.
Patna High Court Cr.Misc. No.15599 of 2015 (02) dt.20-05-2015 2/2 It is submitted by learned counsel for the petitioner that except the confession of Vinay Kumar there is nothing against the petitioner and thrust of accusation is against Vinay Kumar. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 07 of 2015.
