The petitioner seeks bail in Bettiah (T) P.S. Case No. 116 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, four unknown persons barged into Bettiah Branch, Mahindra Finance Company and looted cash of Rs. 1,01,400/- from the cash counter and Rs. 1,03,000/- from one Raj Kumar Mishra.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of petitioner surfaced during course of investigation on the basis of confessional statement of co-accused. No looted article has been recovered

Patna High Court CR. MISC. No.2199 of 2022(3) dt.28-04-2022 2/2 from his possession. Till date petitioner has not been put on test identification parade. Petitioner is in custody since 28.07.2021. Learned APP however, vehemently opposed the prayer for bail and submitted that petitioner is habitual offender and he is accused in as many as twelve cases of similar nature. Considering the facts aforesaid and criminal antecedent, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
