The petitioner is languishing in custody since 12.11.2014 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

On motorcycle being stolen the FIR was lodged against unknown. The petitioner confessed his guilt on his arrest. From the confession of co-accused it transpired that petitioner and co-accused committed the offence. It is submitted by learned counsel for the petitioner that the recovery has not been made from the petitioner. The petitioner's complicity also transpired from the CCTV

Patna High Court Cr.Misc. No.21232 of 2015 (2) dt.07-07-2015 2/2 footage of the hotel where the motorcycle was parked. The investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sadar Motihari in connection with Chhatauni P.S. Case No. 237 of 2014.

Since the petitioner is accused in four other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
