The allegation, primarily, appearing in the First Information Report was that the victim had been taken away or enticed away for purposes indicated under Section 366A of the Indian Penal Code. However, the victim was recovered and her statement was recorded under Section 164 Cr.P.C., a copy of which has been annexed as Annexure-2 to the present petition and on perusal of the same, it appears that it may not be a case either under Section 364 or 366A of the Indian Penal Code and that it could be a simple case under Section 365 of the Indian Penal Code.

Let petitioner Aditya Kumar Singh @ Aditya Kumar be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.15353 of 2015 (3) dt.29-07-2015 2 / 2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 236 of 2014.
