The petitioner is languishing in custody since 16.06.2018 in a case registered for the offence punishable under Sections 387,120B/34 of the Indian Penal Code. The prosecution case is that the informant on 5.04.2018 and 01.06.2018 received extortion calls of Rs.15,00,000/-. Subsequently, during investigation it was found that one of the mobile numbers through which the extortion was demanded is registered in the name of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner and the informant were friends hence,

Patna High Court Cr.Misc. No.7718 of 2019(2) dt.11-02-2019 2/2 without verifying the fact regarding the content of the talk, the accusation has been levelled against the petitioner. It is further submitted that even assuming the accusation to be true, no offence under Section 385 of the I.P.C is made out against the petitioner and the investigation has already been concluded. Though the petitioner is accused in one other case apart from the present case, but in that case he is on bail. Learned APP for the State submits that one of the mobile numbers was found registered in the name of the petitioner through which the extortion was demanded. Considering the aforesaid fact and the investigation being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran, in connection with Bettiah Town (Kalibag O.P.) P.S. Case No. 514 of 2018. (Dinesh Kumar Singh, J) Ashwini/- U T
