The petitioner seeks regular bail in connection with Vaishali Police Station Case No. 325 of 2021, registered for the offences punishable under Sections 494/498-A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The prosecution case, as per the First Information Report, is that the marriage of the informant was solemnized with the petitioner on 17.06.2018 and after the marriage, the petitioner, along with his family members started demanding dowry and due to non-fulfillment of the said demand, the accused persons tortured the informant, both mentally and physically, and ousted the informant from her matrimonial home. He further submits that the informant had left her matrimonial home out of her own will. He further submits that the petitioner is in custody since 04.09.2021 and charge sheet has already been submitted against him and as such there is no likelihood that the petitioner will abscond and/or tamper with the evidence. Regards being had to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that there is general and omnibus allegation against the accused persons, charge sheet has already been submitted and the petitioner is in custody since 04.09.2021, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Vaishali Police Station Case No. 325 of 2021.
