The petitioner apprehends his arrest in Baisi P.S. Case No.91 of 2018, corresponding to Special Excise Case No.366 of 2018 registered under Sections 272, 273 of the Indian Penal Code and under Section 30(a) of Bihar Prohibition and Excise Act.

The police apprehended Abhay Kumar and Govind Kumar from a vehicle and about 3 liters of Indian made foreign liquor was recovered. The apprehended accused Govind Kumar disclosed that he had taken the vehicle of Pankaj Kumar, his

Patna High Court Cr.Misc. No.3817 of 2019(2) dt.25-01-2019 2/2 cousin for taking his son to school.

The learned counsel for the petitioner submits that petitioner is a practitioner and his fufera brother took the vehicle of the petitioner for taking his child to the school. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Purnea in connection with Baisi P.S. Case No.91 of 2018, giving rise to Special Excise Case No.366 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
