JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner No. 1 who is sister-in-law whereas petitioner No. 2 who is the elder brother of the husband of the deceased seek bail in anticipation of their arrest in connection with Sonbarsa Raj P.S. Case No. 100 of 2019 dated 09.07.2019 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that they are separate in mess and business from the husband of the deceased and have been made accused in this case only because of their standing in special relation with the husband of the deceased. The informant has raised allegation against them on the

Patna High Court CR. MISC. No.3413 of 2020(4) dt.05-03-2020 2/2 basis of hearsay information.

Considering the aforestated facts with respect to petitioner No. 1/Sangeeta Devi, she is directed to be released on bail in the event of her arrest or surrender before the Court below within a period of four weeks from today and on her furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Sonbarsa Raj P.S. Case No. 100 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The prayer with respect to petitioner No. 2/Chandan Sharma is hereby rejected. He is directed to surrender before the Court below and seek bail. The application stands disposed off.
